Q&A

When is a good time to consult a lawyer regarding a personal injury claim?

The short answer is that, if at all possible, consult a personal injury lawyer right away in order to ensure that your interest is protected from the onset of any potential claim.

If you do not contact a personal injury lawyer right away, it is important to note that in Ontario the Statute of Limitation for bringing a personal injury claim as a result of a motor vehicle accident or slip and fall accident is two (2) years from the date of the accident for which you are bringing a claim. That means that you must consult a personal injury lawyer within two years from the date the accident occurred.

What should you bring with you to your first free consultation?

If you were involved in a motor vehicle accident and you have a copy of the motor vehicle accident report, bring a copy of the report with you to the consultation as well as any correspondence received from insurance companies or any medical records you may have.

If you had a slip and fall accident, bring in any copies of statements that you may have provided a property owner, manager, employee, or any other person, the address of the property you sustained your injury, and any correspondence from insurance companies that you may have received.

Should you not have any or all of this information that is fine as well. We will discuss the circumstances of your accident and injuries and obtain any necessary information or documentation thereafter.

Should you provide a statement describing your accident and injuries?

Do not provide any statement to anyone acting or associated with the at-fault party prior to consulting a personal injury lawyer.

What are my rights if I am a pedestrian or cyclist that sustained injuries as a result of a motor vehicle accident?

Even if you do not have insurance, you are still entitled to certain accident benefits and you may still have a claim against an at-fault driver. Contact a personal injury lawyer to discuss the matter further and learn what you may be entitled to.
